On January 28, a judge will hear arguments regarding whether prosecutors charged Salvadoran man Kilmar Abrego Garcia with human smuggling in retaliation for challenging his detention.
In order to examine allegations that prosecutors filed human smuggling charges against Kilmar Abrego Garcia in retaliation for his legal actions, including contesting his immigration detention, a federal judge in Nashville has set a hearing for January 28.
Garcia, a Salvadoran man who was wrongfully deported in March 2025 but was later allowed to return following a Supreme Court ruling, disputes the accusations and claims the prosecution is being retaliatory.
The case is related to a traffic stop in 2022 when he had nine passengers in his car and was only given a warning.
Only after Garcia's return did the Department of Homeland Security start looking into the matter.
