A federal judge has canceled the trial of Kilmar Abrego Garcia, a Salvadoran man mistakenly deported in March 2025, and scheduled a January 28 hearing to review claims that prosecutors are pursuing human smuggling charges against him vindictively.
Garcia, returned to the U.S. in June after a court order, denies the charges and argues the prosecution is retaliation for challenging his deportation.
The judge found enough evidence to warrant the hearing, requiring prosecutors to justify their decision to charge him.
The case stems from a 2022 traffic stop where Garcia was initially given a warning despite suspected human smuggling, with the investigation reportedly beginning only after the Supreme Court ordered his return.
Garcia, who has no criminal record and was protected from deportation due to gang threats, lives in the U.S. with his American family under ICE supervision.
The U.S. attorney’s office and his defense have not commented.
