A Michigan prosecutor has determined that Presque Isle County deputies acted in self-defense when they shot 33-year-old Edward Fitzgerald during a November 27 police chase in Alpena County.
Fitzgerald, who was pointing a loaded gun at officers after exiting his vehicle, posed an immediate threat, justifying the use of force under state law.
Both deputies provided first aid, which likely saved his life.
Fitzgerald was arraigned on December 26 on multiple charges including assault with a dangerous weapon and fleeing police, released on a $250,000 bond, and is scheduled for his next court appearance on December 30.
