Illinois expands unpaid parental leave for NICU newborns, with up to 20 days, starting Jan. 1, 2026.
Illinois is expanding job-protected unpaid leave for parents with newborns in the NICU, effective January 1, 2026, with up to 10 days for employers with 16–50 workers and up to 20 days for larger employers.
The law requires employers to maintain health benefits and guarantee job reinstatement, and employees must first use FMLA leave before accessing NICU leave.
Additional 2026 changes include a ban on discriminatory AI use in hiring, protection for employees documenting domestic violence on work devices, expanded anti-discrimination protections, paid leave for organ donors and military funeral honors, and a three-year pilot program allowing unemployment benefits for those leaving work due to mental health reasons.
