Her legal team argues the pardon, citing historical precedent, should apply to state crimes, but Colorado’s attorney general, Phil Weiser, rejects the claim, stating the president lacks authority over state convictions and calling the idea unconstitutional.
The appeals court has allowed the state until January 8 to respond, with oral arguments set for January 14.
State prison officials have refused to release Peters, and a prior federal court denied her request for release.
If the appeals court rules against her, her attorneys say they may appeal to the U.S. Supreme Court.
