Delhi High Court blocks ED from issuing non-bailable warrants without strict legal grounds, ruling against UK-based businessman Sachin Dev Duggal.
The Delhi High Court ruled that the Enforcement Directorate (ED) cannot issue non-bailable warrants (NBWs) during investigations unless strict legal conditions under Section 73 of the Code of Criminal Procedure are met, setting aside NBWs against UK-based businessman Sachin Dev Duggal.
The court stated NBWs are only permissible in specific cases—such as for escaped convicts, proclaimed offenders, or those evading arrest—and found none applied to Duggal, who was not accused or fleeing.
Non-compliance with a PMLA summons under Section 50 does not justify NBWs, the court held, and may only lead to action under Section 174 of the Indian Penal Code.
The decision limits the ED’s investigative powers, reinforcing that NBWs are an exceptional measure, not a routine tool.
The ruling, delivered on December 19, was a significant clarification on the boundaries of investigative authority under the PMLA.
