A judge decides if ICE can re-detain Salvadoran man Kilmar Abrego Garcia, released Dec. 11 due to lack of legal basis for detention.
A federal judge, Paula Xinis, will rule on whether ICE can re-detain Kilmar Abrego Garcia, a Salvadoran national released on December 11 after a judge found his detention lacked legal basis.
The decision follows a prior wrongful deportation to El Salvador in March, a Supreme Court-ordered return in June, and ongoing human smuggling charges in Tennessee.
Garcia, who has lived in the U.S. since childhood and has an American family, was never issued a formal removal order, and a court blocked his return to El Salvador due to persecution fears.
The government’s proposed deportation to African nations has been rejected due to lack of consent, and the judge questioned officials’ credibility after false claims about Costa Rica’s willingness to accept him.
His attorneys seek sanctions over public statements by government officials that may prejudice his case.
The judge has extended a temporary restraining order preventing re-detention while she evaluates the government’s removal plan.
