A New York woman sued St. Mary’s Healthcare for violating credit reporting laws by rescinding her job offer based on outdated records without proper notice.
Christen Burton of New York has filed a federal class action lawsuit against St. Mary’s Healthcare in Amsterdam, alleging violations of the Fair Credit Reporting Act during her job hiring process.
She was offered a position in September 2024, completed onboarding steps, but had her offer rescinded less than a day after learning the hospital obtained her consumer report, which included outdated public records over 20 years old.
The lawsuit claims St. Mary’s failed to provide a pre-adverse action notice or a copy of the report, denied her right to review or dispute the information, and used data beyond the FCRA’s 10-year limit.
Though Burton initially consented to the report, the lawsuit argues the consent was invalid due to procedural failures.
The hospital denies wrongdoing, stating it followed the law and plans to defend itself.
The case seeks damages and class action status for others affected.
