The Supreme Court of India has ruled that courts must prioritize wildlife, especially elephants, over commercial development when migration routes are threatened.
On December 19, 2025, the court emphasized that animals are silent victims of habitat encroachment, particularly in the Nilgiris’ Sigur Plateau, where over 800 structures—including 39 resorts and 390 homes—were built on designated elephant corridors.
The Madras High Court had previously upheld a top court-appointed panel’s finding that these constructions were illegal and must be removed.
Resort owners argued they purchased land before the corridors were notified and sought permission to continue eco-friendly operations without expansion.
The Supreme Court agreed to hear all related cases together, scheduling a final hearing for January 5, 2026, while reaffirming that conservation takes precedence in cases of uncertainty.
