The Justice Department is appealing a federal judge’s dismissal of criminal cases against former FBI Director James Comey and New York Attorney General Letitia James, citing the improper appointment of prosecutor Lindsey Halligan as interim U.S. Attorney.
Judge Cameron Currie ruled the indictments invalid due to Halligan’s prior White House role, which violated federal law requiring Senate confirmation.
The department had attempted twice to reindict James with new prosecutors, both efforts failing.
The appeal, now pending before the 4th Circuit Court of Appeals, seeks to revive the cases, which allege obstruction of justice and mortgage fraud.
Key evidence in the Comey case was also excluded due to improper seizure.
