In December 2025, Kenya’s High Court ruled key parts of the 2012 Seed and Plant Varieties Act unconstitutional, protecting smallholder farmers’ rights to save, share, and exchange indigenous seeds.
The decision, led by Justice Rhoda Rutto, removed criminal penalties for using unregistered seeds, affirming traditional farming practices and supporting food sovereignty.
The case, brought by 15 farmers with backing from Greenpeace Africa, follows a March 2025 ruling upholding Kenya’s GMO ban.
The win is seen as a major step in resisting corporate control over agriculture and promoting community-led, climate-resilient food systems.
