The Irish Attorney General has decided not to prosecute Enoch Burke, his siblings Isaac and Ammi, and their mother Martina for criminal contempt over repeated courtroom disruptions, citing high costs, limited impact of penalties, and risk of reinforcing martyrdom.
The decision, made after a request from High Court Judge Brian Cregan, acknowledges serious breaches of the rule of law but concludes criminal charges would be ineffective given Enoch’s current imprisonment for civil contempt.
The court may still act independently.
Enoch Burke, serving time for trespass at Wilson’s Hospital School, remains defiant, refusing to promise not to return if released.
A disciplinary appeals panel is reviewing his dismissal, with a decision expected by January 9.
