Gujarat's high court rules Waqf boards must pay court fees, ending special exemption.
The Gujarat High Court has ruled that Muslim Waqf institutions must pay court fees to file cases before the State Waqf Tribunal, rejecting around 150 petitions seeking exemption.
The court, led by Justice JC Doshi, stated that proceedings before the tribunal are judicial in nature and fall under the Gujarat Court Fees Act, 2004, just like civil suits.
The decision ends a prior exemption that applied only to Waqf cases, aligning them with fees required for temples, gurdwaras, and other religious institutions.
Deputy Chief Minister Harsh Sanghavi called the ruling a "historic decision" promoting legal uniformity.
In a separate case, the Tamil Nadu Waqf Board claims a stone pillar in Madurai belongs to the Sikandar Badusha Dargah, citing a 1920 court finding, but the state disputes its religious significance and the matter remains before a civil court.
