Texas sues Xcel over Smokehouse Creek fire, blaming faulty power lines for the record-breaking blaze.
Texas has sued Xcel Energy, operating as Southwestern Public Service Company, over the Smokehouse Creek fire—Texas’s largest wildfire on record—which burned over 1,500 square miles in 2024, killed three people, and caused more than $1 billion in damage.
The state alleges the fire was sparked by downed power lines from a decaying utility pole, accusing Xcel of negligence for failing to maintain aging infrastructure, including poles nearly 100 years old.
While Xcel acknowledged its equipment likely caused the blaze and has paid over $361 million to settle most claims, it disputes the negligence allegations, stating it cooperated with investigators and will defend itself in court.
The lawsuit seeks to recover state damages and prevent the utility from passing costs to customers.
