Madison Home, Inc. has sued Richmond, Kentucky, seeking a temporary injunction to keep its winter shelter open after the city denied a certificate of occupancy, citing the need for a sprinkler system.
The nonprofit, which has operated the shelter since 2022 under a conditional use permit and served about 800 people in 2024, argues the historic building qualifies for a fire code exception, has working fire escapes, and has passed inspections.
It claims the city’s decision is inconsistent and risks endangering homeless individuals during winter.
The city says it has supported the shelter with funding, volunteers, and guidance to meet code.
The shelter is currently operating with guests housed at a nearby center at night while daytime services continue.
The court has not yet ruled.
