Louisiana has settled two federal lawsuits against CVS Health and its pharmacy benefit manager, Caremark, over allegations of anti-competitive practices that harmed independent pharmacies and inflated drug prices.
The state claimed Caremark underpaid pharmacies, steered patients to CVS-owned locations, and used spread pricing and rebate systems that increased costs, particularly for insulin.
The cases were dismissed by a federal judge on December 10, with the possibility of reopening if a final agreement isn’t reached.
A third lawsuit remains pending, alleging CVS used customer data to send political messages opposing legislation targeting its business model.
Settlement terms were not disclosed.
