A federal judge, Paula Xinis, ordered the immediate release of Kilmar Abrego Garcia, a Salvadoran national wrongfully deported to El Salvador in March 2025 despite a 2019 court order protecting him from deportation due to fear of gang violence.
Garcia, who lives in Maryland with his U.S. citizen wife and child, was returned to the U.S. in June and faced human smuggling charges in Tennessee, which he denies.
Judge Xinis ruled that the government lacked legal authority to detain him, citing no final removal order and misleading claims about deportation plans to African countries.
She criticized the government for inconsistent removal efforts and ordered his release by 5 p.m.

The Department of Homeland Security called the ruling judicial overreach and vowed to appeal.
