Kenya’s High Court pauses $1.6B U.S. health deal over data privacy concerns.
Kenya’s High Court has temporarily suspended a $1.6 billion U.S. health cooperation agreement signed on December 4, 2025, over concerns about the unauthorized transfer of sensitive medical and personal health data.
The ruling, issued by Justice Bahati Mwamuye, halts any sharing or dissemination of health data under the deal pending a legal challenge filed by the Consumer Federation of Kenya, which argues the agreement breaches data protection laws and was made without public consultation.
The case, set for mention in February 2026, centers on fears that Kenyan health data could be used abroad without oversight, risking privacy violations and misuse.
President William Ruto has stated the agreement was reviewed for compliance with Kenyan law.
