IndiGo seeks ₹900 crore customs refund, claiming double taxation on re-imported aircraft parts, amid ongoing legal and operational crises.
IndiGo has petitioned the Delhi High Court for a ₹900 crore refund of customs duty on aircraft parts re-imported after overseas repairs, arguing the tax amounts to unconstitutional double taxation since the airline already paid GST on the repair services.
The airline contends that such re-imports should be treated as service imports, not goods, citing prior court rulings supporting this view.
Despite these decisions, customs authorities denied refunds, requiring payment under protest across 4,000 bills of entry.
The case, originally assigned to a bench including Justice Shail Jain, will be reassigned after she recused herself due to her son’s employment with IndiGo.
The dispute is already pending before the Supreme Court.
The legal action comes amid a major operational crisis for IndiGo, marked by widespread flight cancellations due to pilot shortages and regulatory scrutiny, prompting government-imposed capacity limits and a probe into its operations.
