Arkansas Supreme Court lets mothers join lawsuit over education voucher program's legality.
The Arkansas Supreme Court has allowed three mothers of students in the Education Freedom Account program to intervene in a lawsuit challenging its constitutionality, ruling they have a direct legal interest due to potential financial loss if the program is ended.
The 4-3 decision, which upholds a lower court’s rejection of the state’s motion to dismiss, finds that the state cannot block the case through sovereign immunity, especially in claims involving illegal use of public funds.
The lawsuit, filed in June 2024, argues the program violates the state constitution by diverting taxpayer money to private education.
The case continues, with the EFA program set to distribute $326 million to nearly 47,000 students in 2025-26.
