Australia's top court overturns Greg Lynn’s murder conviction due to trial flaws, ordering a retrial.
A Victorian Court of Appeal has overturned Greg Lynn’s 2024 murder conviction in the death of 73-year-old Carol Clay, citing serious trial irregularities that caused a substantial miscarriage of justice.
The three-judge panel found prosecutors breached fairness rules during closing arguments and failed to allow Lynn to respond to allegations about post-offense actions, including burning bodies and destroying a campsite.
Lynn, a former pilot, admitted to burning the bodies of Clay and her companion Russell Hill but claimed the deaths were accidental.
A split jury had convicted him of Clay’s murder but acquitted him of Hill’s.
The court ordered a retrial, and prosecutors will decide whether to pursue manslaughter charges for both victims.
Lynn remains in custody and is scheduled to return to Supreme Court on January 28 for a directions hearing.
Hill’s daughters were emotional during the ruling.
