Delhi court orders Choudhary to notify news platforms before removing defamatory content, stressing due process.
The Delhi High Court has ordered Jammu and Kashmir Deputy Chief Minister Surinder Kumar Choudhary to include news platforms and content uploaders in his defamation case before seeking removal of allegedly defamatory material.
Justice Amit Bansal emphasized that no takedown can occur without hearing the entities involved, particularly since much of the content appears to originate from local news channels.
Choudhary, who took office in October 2024, filed the suit over a fabricated audio clip with sexual undertones, claiming it harms his reputation.
The court questioned why the issue was raised only now, noting some content dates to 2023, and directed social media platforms to provide uploader details within three days.
The case was advanced to December 16, 2025, and Choudhary must serve notices on all involved parties, ensuring due process in digital defamation cases.
El tribunal de Delhi ordena a Choudhary que notifique a las plataformas de noticias antes de eliminar contenido difamatorio, haciendo hincapié en el debido proceso.
