Two Native tribes seek federal review of court rulings denying their water rights claims, citing misapplied precedent and broken trust obligations.
The Winnemucca Indian Colony is seeking a full panel review of a federal appeals court decision that dismissed its $208 million lawsuit over alleged mismanagement of tribal water resources by the Bureau of Indian Affairs.
The tribe argues the court wrongly applied the 2023 Supreme Court ruling in Arizona v. Navajo Nation to dismiss claims about existing water diversions, asserting the precedent does not apply to its case.
Meanwhile, the Pyramid Lake Paiute Tribe is also challenging a court decision that denied its claim to Truckee River water, contending the ruling misapplied Navajo Nation’s precedent and undermines treaty rights.
Both tribes stress the federal government’s trust responsibility and seek legal clarity on water rights.
In a separate development, over 40 residents from Dził Yíjiin and surrounding areas urged Navajo Nation leaders to oppose the renewal of the Kayenta Mine permit, citing environmental damage, health concerns, and broken promises, with community leaders pledging to convey their opposition to tribal leadership.
