The Rajasthan High Court ruled that consenting adults, even if below the legal marriage age, have the constitutional right to live together in a live-in relationship under Article 21, which protects life and personal liberty.
The decision, issued by Justice Anoop Dhand, came after an 18-year-old woman and 19-year-old man from Kota filed a protection plea, claiming family opposition and threats of violence, with police failing to act on their complaint.
The court rejected arguments that the man’s age barred such relationships, stating that personal autonomy and consent are central to constitutional rights.
It directed police to verify threats and provide protection if needed, affirming that live-in relationships are not illegal and must be respected, though they do not grant the same legal rights as marriage.
