A mistrial has been declared in the trial of Timothy Kennedy, accused of killing West Virginia State Trooper Cory Maynard in a June 2023 ambush, after juror misconduct during a four-day jury selection in Mingo County.
Judge Joshua Butcher granted the defense’s motion, citing concerns over biased jurors, with surveys showing most potential jurors had heard of the case and believed Kennedy guilty.
The trial, delayed multiple times, will restart in 2026 with new jury selection, possibly in a different jurisdiction.
Kennedy faces five charges, including first-degree murder and armed robbery, and remains jailed.
The judge may allow body camera footage to be shown, pending further motions.
