Idaho Senator Carl Bjerke is considering recommending legislation based on Kayden’s Law to enhance child safety in custody cases, following tragedies in Utah and Pennsylvania.
The federal law, enacted in 2022, mandates supervised visits when abuse is involved, requires court training on domestic violence, restricts reunification therapy unless proven safe, and limits expert testimony to qualified professionals.
Bjerke, part of Idaho’s Child Custody and Domestic Relations Task Force, believes the law offers a proven framework to protect children, especially when abuse histories exist.
The task force, which can only recommend changes, will present its proposals by December 10, 2025, for consideration during the 2026 legislative session.
