Australia’s High Court upholds Tsalkos’s 1987 rape convictions, rejecting his appeal over jury instructions.
Australia’s High Court has upheld the 2023 convictions of Theodoros Tsalkos, now in his 60s, for raping two teenage sex workers in Melbourne in 1987.
He was found guilty of multiple counts of rape and kidnapping after allegedly impersonating a police officer to abduct the girls, hold them captive in his car, and assault them over several hours, including at a secluded toilet block.
A jury convicted him following a trial where the judge called the crimes “pure evil.” Tsalkos appealed, arguing a jury misdirection regarding a victim’s mother’s testimony about her daughter’s distress.
Victoria’s Court of Appeal overturned the verdict in December 2024, citing a substantial miscarriage of justice.
The High Court unanimously reversed that decision, ruling the trial judge’s instructions were not flawed and the mother’s evidence could support the prosecution’s case.
The original convictions stand, meaning Tsalkos will not face a retrial, though his request to appeal his 13-year, six-month sentence will be reconsidered by the Court of Appeal.
