The Waitangi Tribunal has ruled that excluding the Treaty of Waitangi from New Zealand’s draft geothermal development strategy breaches the Treaty, citing inadequate recognition of Māori guardianship, mischaracterization of geothermal resources as mere "surface features," and insufficient provisions for iwi and hapū economic opportunities.
The strategy, aimed at doubling geothermal energy by 2040, was criticized for failing to uphold the Treaty partnership, especially after the Crown included the Treaty in a similar minerals strategy months earlier.
The Tribunal urged the Crown to revise the plan through meaningful consultation with Māori groups, correct definitions of geothermal taonga, and address unresolved customary rights before finalization.
