Montana creates judge evaluation panel to boost transparency ahead of 2026 elections.
Montana has created a Judicial Performance Evaluation Commission to assess state judges, following the 2025 passage of Senate Bill 45.
The 11-member panel, appointed by the governor, chief justice, and legislative leaders, will evaluate Supreme Court and district court judges midway through and before re-election, using data from court staff, attorneys, jurors, case backlogs, and appellate reversals.
Reports will be confidential unless a judge seeks re-election, at which point they’ll be posted online.
Governor Greg Gianforte’s amendatory veto removed a plan to include evaluations in the voter pamphlet, opting for public posting instead.
The first evaluations won’t be available for the 2026 elections due to timing rules.
The initiative, backed by nearly all Republicans and opposed by Democrats, aims to increase transparency and inform voters, with leaders citing Utah’s model and emphasizing a nonpartisan approach.
