India's government seeks urgent Supreme Court review of a ruling letting states tax mineral rights, fearing financial chaos and loss of federal control.
The Indian central government has asked the Supreme Court to fast-track a curative petition challenging a July 2024 ruling that granted states power to tax mineral rights, arguing the decision undermines federal authority and could trigger massive retrospective tax demands.
The 8:1 verdict had ruled that royalty payments are not taxes and that states may tax mineral rights under the State List, allowing them to recover dues from 2005 over 12 years starting April 2026.
The Centre claims the ruling threatens fiscal stability and national economic integration, urging the Court to prioritize the curative plea.
The Court has not yet decided on the request.
