Steven Gardiner, a Christchurch man, was sentenced to two months of community detention and nine months of intensive supervision after unlawfully attempting a citizen’s arrest on David Hoffman in January 2025.
Frustrated by the slow police response to a December 2024 assault, Gardiner and three associates entered Hoffman’s home, where Gardiner used a self-made warrant and physically restrained him, leading to a violent confrontation.
Gardiner and associate Davies were convicted of common assault and wilful trespass; Hoffman suffered facial fractures and lacerations.
Judge Stephen O’Driscoll ruled Gardiner had no legal authority for a citizen’s arrest, calling the actions unjustified.
Hoffman had previously been convicted of the original assault.
The case highlights the legal limits of self-help justice.
