Canada's Supreme Court overturned Nathan Johnson's murder conviction due to new evidence from his co-accused's acquittal.
The Supreme Court of Canada has sent Nathan Johnson’s murder conviction back to the Nova Scotia Court of Appeal, citing new evidence from the 2023 acquittal of his co-accused, Randy Riley.
Johnson was convicted in 2010 of killing pizza delivery worker Chad Smith and sentenced to life in prison with no parole for 25 years.
His prior appeals were rejected in 2017 and 2022.
The court’s decision to reopen the case follows claims that Riley’s acquittal undermines the credibility of two Crown witnesses.
The case is now pending further review in the Nova Scotia Court of Appeal.
