A federal judge rules Trump's mandatory detention policy illegal, ordering bond hearings for thousands of detained migrants.
A federal judge in California has ruled that the Trump administration must provide bond hearings to thousands of migrants detained in the U.S., declaring its policy of mandatory detention without such hearings illegal.
The decision, issued by Judge Sunshine Sykes, applies nationwide and establishes a class of non-citizens already living in the country who were detained during enforcement operations and are now entitled to seek release on bond.
The judge found the administration’s July policy, which expanded mandatory detention to include non-citizens not arriving at the border, violates due process and federal immigration law.
The ruling restores a practice from the past three decades, allowing detainees to argue they are not a flight risk or danger.
It affects approximately 65,000 people in detention as of late November 2025.
The Department of Justice and plaintiffs’ attorneys did not immediately respond to requests for comment.
