DHS Secretary Kristi Noem defied a judge’s order to halt deportation flights to El Salvador, citing legal authority under the Alien Enemies Act.
In a November 2025 court filing, the Justice Department confirmed that DHS Secretary Kristi Noem authorized the continuation of deportation flights to El Salvador despite a federal judge’s March order to halt them.
The flights, part of a Trump administration effort to remove Venezuelan gang members under the Alien Enemies Act, proceeded even after Judge James Boasberg issued a restraining order citing due process concerns.
The DOJ argued the court’s order did not require returning those already deported and maintained the actions were lawful.
Boasberg has resumed his contempt inquiry, while an appeals court allowed the fact-finding process to continue.
