Delhi High Court to review if India-UAE treaty overrides domestic law in Michel’s extradition case.
The Delhi High Court has issued a notice to the Indian government on a plea by Christian Michel, extradited in 2018 over the AgustaWestland chopper scam, challenging the India-UAE extradition treaty’s supremacy over India’s Extradition Act, 1962.
Michel’s lawyer argues the treaty cannot override domestic law, claiming new charges violate the Doctrine of Speciality and Section 21 of the Act, which limits prosecution to specified offences.
He asserts Michel has already served the maximum sentence for original charges and that continued detention is unlawful, violating constitutional rights.
The court has directed government agencies to respond and set a hearing for January 9.
