A New Zealand Human Rights Review Tribunal ruled that Skykiwi did not discriminate against Auckland resident May Moncur when it deactivated her forum account in 2021, despite her claim of political bias.
Moncur, a long-term resident from China, was suspended after comparing the site’s moderation to censorship during China’s Cultural Revolution.
Skykiwi said the action followed its rules against political content, which were violated by her post and ensuing discussions.
The tribunal found no human rights breach, stating the suspension was based on content rules, not political opinion, though it noted possible contract law violations.
Moncur disputed the ruling, alleging Skykiwi allows criticism of Western governments but censors China-related content, a pattern she says harms free expression among Chinese-New Zealanders.
Skykiwi, serving 480,000 users and 93% of New Zealand’s Chinese community, maintains its policies are consistently applied.
