Montana clears path for nonpartisan court elections initiative, set for 2026 ballot.
Montana’s Constitutional Initiative 132, aimed at enshrining nonpartisan judicial elections in the state constitution, has cleared legal hurdles, allowing signature gathering to begin.
The Montana Supreme Court ruled the attorney general’s revised ballot summary misleading, ordering the use of the original version that clarifies the measure would preserve, not change, existing nonpartisan elections.
The court also blocked a second proposal, Ballot Issue #6, for combining multiple changes in one amendment.
Supporters, including former justices, argue nonpartisan elections protect judicial independence, while critics say party labels help voters assess judicial leanings.
The initiative will now move toward the November 2026 ballot.
