A federal judge has ordered the Trump administration to restart a 2022 program protecting young immigrants with Special Immigrant Juvenile Status (SIJS) from deportation, following a lawsuit.
The decision requires USCIS to resume processing work permit applications and deferred action for youth who were abused, neglected, or abandoned and obtained SIJS through state courts.
The program, rescinded in June, previously allowed these individuals to seek legal residency and work authorization while awaiting visas, which are limited annually.
The court’s order allows the program to continue during ongoing litigation, though no class has been certified.
USCIS and DHS did not comment.
