David Maltinsky, a 16-year FBI veteran nearing completion of special agent training, was fired in November 2025 after displaying a Progress Pride flag at his Los Angeles office desk, according to a federal lawsuit.
The flag, previously flown outside the office and given to him with supervisor approval, symbolized LGBTQ+ inclusivity.
Maltinsky, a decorated intelligence specialist who led diversity initiatives, claims his termination—following a meeting with FBI leadership and a letter from Director Kash Patel citing “inappropriate political signage”—violated his First and Fifth Amendment rights.
The lawsuit, filed in Washington, D.C., names Patel, the FBI, Attorney General Pam Bondi, and the Justice Department as defendants, alleging unlawful retaliation amid broader personnel changes under President Trump’s second term.
Maltinsky seeks reinstatement and a declaration that his rights were violated.
The FBI and Justice Department declined to comment.
