Florida advances bill letting parents sue if unborn child dies due to negligence, expanding wrongful death law to fetuses.
A Florida House committee has advanced HB 289, a bill allowing parents to sue for wrongful death if their unborn child dies due to another’s negligence or harm, expanding the state’s wrongful death law to cover fetuses at any stage.
Sponsored by Rep. Sam Greco, R-St. Augustine, the bill aligns Florida with 43 other states and prohibits lawsuits against mothers or doctors providing lawful care.
Critics, including the ACLU of Florida, warn it could be overly broad, given common miscarriages, and may increase liability for healthcare providers, potentially driving obstetricians from the state amid existing abortion restrictions.
The Senate previously approved a similar version.
The bill now moves to the full House for consideration.
