Montana cities and groups sue over unpermitted wells harming water supplies and rights.
A coalition of Montana cities, farmers, and conservation groups has sued the state and the Department of Natural Resources and Conservation over exempt wells, which allow small water withdrawals without permits.
They argue that about 141,000 such wells since 1973 have strained aquifers, threatened municipal water supplies, and undermined senior water rights, especially in closed basins.
The wells operate outside the state’s water rights system, preventing notice and objection, weakening enforcement during shortages.
The lawsuit follows a 2024 court decision that created uncertainty for some developments.
While the Montana Farm Bureau says the goal is responsible water use, not eliminating exemptions, it says legislative fixes have failed, prompting legal action.
The DNRC acknowledged the suit but will not comment during litigation.
