India's Supreme Court reversed its May ruling, allowing retrospective environmental clearances to prevent damage to ₹20,000 crore in infrastructure.
On November 18, 2025, India’s Supreme Court, in a 2-1 decision, recalled its May 2025 ruling that had banned retrospective environmental clearances for projects violating norms.
The court reversed course, citing potential harm from demolishing infrastructure worth ₹20,000 crore, including public projects, and referred the matter to a larger bench.
While the majority upheld the possibility of retrospective clearances under certain conditions, Justice Ujjal Bhuyan dissented, calling the move a threat to environmental law.
The earlier judgment, which invalidated a 2017 notification and a 2021 office memorandum, remains partially stayed, with projects already cleared unaffected.
