EPA narrows Clean Water Act to protect only major waterways, following Supreme Court ruling.
The EPA has issued a rule limiting the Clean Water Act’s protections to relatively permanent waters such as rivers, lakes, and wetlands directly connected to them, following the 2023 Supreme Court Sackett v. EPA decision.
Administrator Lee Zeldin emphasized that the rule clarifies legal boundaries and reduces regulatory burdens for farmers, ranchers, and landowners.
While states and tribes can continue regulating waters outside federal jurisdiction, environmental groups warn the change could weaken wetland and water quality protections, posing risks to ecosystems and climate resilience.
Public comment on the rule is open for 45 days.
