Danny Masterson, convicted in 2023 of raping two women in 2003, has filed a petition to overturn his 30-year-to-life sentence, claiming his trial attorney, Philip Cohen, provided ineffective representation by failing to present key witnesses and exculpatory evidence.
He alleges Cohen ignored evidence including testimony from individuals who might have supported the women’s consent and experts on alcohol and drug effects on memory.
The petition also claims judicial bias by Judge Charlaine F. Olmedo, who allowed the prosecution to portray the Church of Scientology—of which Masterson is a member—as coercive.
The case stems from a retrial after a mistrial, and the petition is separate from Masterson’s ongoing appeal.
He remains incarcerated at California Men’s Colony and is not eligible for parole for over two decades.
