South Africa's high court rules SIU's probe into Mabuyane's degree fraud claims unconstitutional, but SIU says its expanded investigation continues.
A South African high court ruled the SIU's probe into Eastern Cape Premier Oscar Mabuyane's alleged academic fraud unconstitutional, halting the previous investigation.
However, the SIU says its expanded probe continues under a 2024 presidential proclamation that broadened its mandate to include bachelor’s, master’s, and PhD degrees.
The court found the earlier investigation an abuse of process, but the SIU and University of Fort Hare state the ruling does not affect the current probe.
Mabuyane, who was deregistered from a master’s program in 2021 and denies wrongdoing, previously blocked the probe via court order.
The Eastern Cape ANC welcomed the ruling as protection against political attacks, while Mabuyane’s office plans to challenge Fort Hare’s deregistration process.
