India's top judge urges excluding wealthy SC/ST members from reservation benefits to ensure fairness.
Chief Justice of India BR Gavai reiterated his support for excluding the "creamy layer" from reservation benefits for Scheduled Castes, arguing that children of high-ranking officials should not receive the same advantages as impoverished families.
Speaking at a constitutional event in Amaravati, he said the principle from the Indra Sawhney case—applying the creamy layer concept to Other Backward Classes—should also apply to Scheduled Castes.
With retirement imminent, he emphasized the Constitution’s evolving nature, the importance of equality and justice, and the need for states to create policies to identify and exclude affluent SC and ST individuals from reservation benefits.
He highlighted India’s progress in gender equality and its history of having SC and ST leaders in top offices, including a current ST-origin woman President.
