Oklahoma Attorney General Gentner Drummond has ordered the state wildlife agency to stop prosecuting tribal members for hunting and fishing on reservations without state licenses, calling the policy unlawful and a threat to tribal sovereignty.
In a Nov. 13 letter, he cited federal law, treaty rights, and the potential for legal liability, warning the enforcement actions waste resources and harm state-tribal relations.
The move follows a dispute with Governor Kevin Stitt, who appointed a special prosecutor to handle such cases, claiming state authority.
Drummond argues the policy misinterprets federal rulings and treaty agreements, and plans to dismiss charges if the policy continues.
