The Calcutta High Court has disqualified Mukul Roy, a former BJP MLA from Krishnanagar North, from the West Bengal Legislative Assembly, ruling he violated the anti-defection law by switching to the Trinamool Congress in August 2021.
The court, citing evidence of his public allegiance to the TMC, declared his membership invalid effective June 11, 2021, and nullified his appointment as Chairman of the Public Accounts Committee.
It criticized the Assembly Speaker for delaying action and acting improperly, calling the decision “perverse.” This marks the first time a high court in West Bengal has disqualified an MLA under the Tenth Schedule, setting a precedent on political loyalty and party discipline.
