Benjamin Joseph Swann, 31, was sentenced to 13 years in prison for fatally assaulting 115-day-old Elijah in Werribee, Australia, in January 2024, after causing non-survivable brain injury with blunt force trauma.
The attack occurred around 4 a.m. while Swann attempted to soothe the crying infant.
The baby’s mother, Elyce, found Elijah gasping and turning blue, prompting her to call an ambulance despite Swann’s refusal.
Elijah died the next day after being taken off life support.
Swann initially denied involvement, blaming the mother’s post-natal depression, but later pleaded guilty to child homicide.
Victorian Supreme Court Justice James Gorton described Swann’s actions as callous and remorseless, noting the infant’s vulnerability.
While acknowledging Swann had begun anger management efforts with moderate rehabilitation potential, the judge emphasized the crime’s severity.
Swann will be eligible for parole after serving nine years and six months.
