Artist Anish Kapoor is considering legal action after U.S. Border Patrol agents posed for a photo in front of his Chicago sculpture, Cloud Gate, during a period of intensified immigration enforcement.
Kapoor condemned the image, calling it emblematic of "fascist America" and criticizing the use of a public artwork for what he described as a militarized, politically charged event.
The incident occurred amid over 1,000 arrests since September, with agents seen with firearms and guard dogs in a neighborhood known as Little Village.
Kapoor, who previously settled a lawsuit with the NRA over unauthorized use of his work, is exploring legal options against a federal agency.
His upcoming 2026 exhibition at London’s Hayward Gallery will feature around 40 works, including new large-scale installations, as part of the Southbank Centre’s 75th-anniversary celebrations.
